Life in Canada without valid immigration status is a daily struggle. Undocumented people face challenges in obtaining employment, accessing health care and obtaining services for themselves and their families. As time goes on, many people feel stuck and afraid about how to get out of their situation.  Section 25(1) of the Immigration and Refugee Protection Act (IRPA) allows some people within Canada to obtain permanent residence on H&C grounds. Some of the factors that will help your application are:

  • If you are established in Canada with strong community or familial connections;
  • If you have spent your time in Canada volunteering or participating in programming;
  • If you have children who may be adversely affected by having to go back to your home country;
  • If you have a medical condition and could not access treatment in your home country;
  • If you would face discrimination, risk or other serious problems if you return to your home country.

At our firm, we believe in the inherent dignity of all people, regardless of your immigration status. We strive to provide a safe, judgement free space to get information about your situation. If you or someone you know is living without documentation, we encourage you to reach out and start the process to regularize your status.
